Metric Mind Limited provides scientifically-validated aptitude assessments through:

• Online testing platform accessible via our website
• Physical testing centers located in various regions
• Assessment results and analytical reports

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover or suspect any security breaches related to our services

4. Test Administration and Integrity

4.1 Test Security

To maintain the integrity of our assessments:

• You may not copy, reproduce, distribute, or share test materials
• You may not use unauthorized aids during testing
• You may not impersonate another test taker
• You may not attempt to reverse-engineer our assessment algorithms

4.2 Proctoring

For online assessments, our platform may use automated proctoring technology to monitor test sessions. By using our online testing services, you consent to this monitoring.

4.3 Result Validity

We reserve the right to invalidate test results if we have reasonable grounds to believe that testing integrity has been compromised.

5. Payment and Refunds

5.1 Fees

Certain services require payment of fees. All fees are stated in the currency indicated on our website and are non-refundable except as required by law or as explicitly stated in our refund policy.

5.2 Refund Policy

Refunds may be provided under the following circumstances:

• Technical issues on our platform that prevent test completion
• Cancellation of test center appointment with at least 48 hours notice
• Other circumstances at our sole discretion

6. Intellectual Property

All content, features, and functionality available through our services, including but not limited to test questions, assessment methodologies, reports, logos, and software, are the exclusive property of Metric Mind Limited and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. This license does not include any rights to:

• Resell or commercially use our services
• Collect and use any test materials or listings
• Derivative works based on our services
• Use data mining, robots, or similar data gathering tools

7. User Content and Data

7.1 User Content

You retain ownership of any personal data and content you submit to our services. By submitting content, you grant us a worldwide, royalty-free license to use, store, and display such content solely for the purpose of providing our services to you.

7.2 Assessment Data

We may collect, analyze, and use anonymized assessment data for research purposes, service improvement, and developing new assessment tools. This data will be aggregated and stripped of personally identifiable information.

7.3 Data Protection

We handle your personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

8. Limitation of Liability

To the fullest extent permitted by law, Metric Mind Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability in any matter arising out of or related to these Terms is limited to the greater of (a) the amount you paid us for the services in the 12 months preceding the event giving rise to liability, or (b) $100.

9. Indemnification

You agree to defend, indemnify, and hold harmless Metric Mind Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our services, or your violation of these Terms.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any dispute arising from these Terms or your use of our services shall be resolved through good faith negotiations. If such negotiations fail, the dispute shall be submitted to mediation before pursuing other remedies.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
